لا يقتصرُ علي عزت بيغوفيتش على ما سبقَ عرضُه مِن بيان طريقةِ إقامة النظام الإسلاميّ في عمومها، ولا على رصدِ الانحرافات الفكريّة والواقعية التي تعاني منها السياسة في العالَم الإسلاميّ، بل يشفع ذلك بمناقشة بعض أهمّ مبادئ النظام الإسلاميّ بطريقةٍ شديدةِ الوضوح كما يجب أن يكون في “إعلان” (بيان) سياسي أيديولوجي، إسلاميّا كان أو غيرَ إسلاميّ.
وقد رأينا أن نُؤخّر عرضَ فصلٍ من كتاب “الإسلام بين الشرق والغرب” حول “الطبيعة الإسلامية للقانون” إلى هذا الجزء من البحث، لتَبدُوَ وحدة فكر عزت بيغوفيتش وأصالتُه في كلّ ما كتب.
أولا: المشكلـــــــــــة الإسلاميّـــــــــــــة ومفهـــــــــــوم النظـــــــــــام الإسلامــــــــــيّ
ينطلق عزت بيغوفيتش، كما انطلق غيرُه مِن قَبْلُ من أمثال جمال الدين الأفغاني ومحمد عبده وشكيب أرسلان ومالك بن نبي وغيرهم، من السؤال عن سبب تأخُّر المسلمين وضعفهم وعدم قدرتهم على تحقيق رؤيتهم للحياة في مجتمعاتهم، أي في المجتمعات ذات الأغلبية المسلمة (الأغلبية العُظمى غالبًا).
لا يرضى عزت بيغوفيتش جواب التجديد الدينيّ النظريّ بالمعنى العبدوي (نسبةً إلى محمّد عبده) ولا جواب الدستوريين ولا جواب التحديث، وهي الأجوبة الثلاثة التي هيمنت على الساحة العربية الإسلامية حوالي قرنٍ من الزمن منذ نهايات القرن التاسع عشر الميلاديّ، وقد تتبّعها ونقدها عبد الله العرويّ في كتابه “الأيديولوجيا العربية المعاصرة” بعد أن لقّبها بحسب ظهورها وشعبيّتها تاريخيًّا -على التوالي-: “الشيخ” و”رجل السياسة” و”داعية التقنية”[1]، قبل أن تأتي محاولات تفسيرية مجدّدة وذات بعد أكثر اجتماعيةً وعُمقًا، وعلى رأسها نظرية بن نبي في الحضارة، والتي يتفق معها عزت بيغوفيتش إلى حد بعيد ولو من غير قصد في ما يبدو.[2]
إنّ الطريق إلى التمكين في رأي صاحب “الإعلان الإسلامي” هو إحياء الإسلام في جميع مجالات حياتنا، الفردية منها والأسرية والمجتمعية، فالإسلام -كما يبيّن بإطناب في “الإسلام بين الشرق والغرب”- رسالةٌ كاملة، تركّز في الآن نفسِه على تهذيب الإنسان وعلى تنظيم العالَم، وإنّ هزيمتنا في المجتمعات الإسلامية بدأت من أنفُسِنا، حين خُنَّا إسلامنا خانتنا القوّة والحُكم والتحكُّم في مصائرنا، إنّه انتقام الأفكار المخذولة[3] وإنّها القابلية للاستعمار[4] كما قال بن نبي عقدينِ من الزمن قبل عزت بيغوفيتش الذي يرى أنّه يكاد يكون من قوانين التاريخ الإسلاميّ أنّه كلّما استمسك المسلمون بدينهم في كافّة مناحي حياتهم كانوا أشدّ تمكينًا وأكثر قوةً وأفضل حالًا، والعكس بالعكس، وقد قال ذاتَ يومٍ أميرُ المؤمنين ثاني الخلفاء الراشدين المهديّين عمرُ بن الخطّاب رضي الله عنه: ((إنكم كنتم أذلَّ الناس وأقلَّ الناس وأحقرَ الناس فأعزكم الله بالإسلام، فمهما تطلبوا العزَّ بغيره يذلَّكم الله)).[5]
إنّ الدعاوى العلمانيّة لفصل الإسلام عن السياسة في العالَم الإسلاميّ مردودةٌ من دون تردُّد، فهي تعاني خطأً جوهريٍّا لا يمكن تصحيحُه إلا برفضها مطلقًا، وهذا الخطأ هو اعتبار الإسلام دينًا مجرَّدًا بالمعنى الأوربيّ، وبالتالي اعتبارُه خاصًّا بشقٍّ معيّنٍ من الحياة لا شاملًا لها جميعِها، في حين أنّ نظامًا سياسيًّا لا يمكن أن يكون إسلاميًّا بحقٍّ إلا أن تتجسَّد فيه الوحدة بين الدين والقانون، وبين التربية والسلطة، وبين المثل الأعلى والمصلحة، وبين الجماعة الروحية والدولة، وبين الإرادة والقوّة. وكلّ حصرٍ للسياسة في الشقِّ الثاني من هذه الثنائيّات يعني نفيَ صفة “الإسلاميّة” عنها، وبعبارة واضحة: إنّ السياسة بتعريفها اليوم ليست محايدةً بتاتًا وهي معارضةٌ للإسلام في أساسِه، لأنّها تُقصي من ميدانِها الشقّ الأوّل من الثنائيات المذكورة، ويتبجّحُ الروّاد من مفكّريها بأنّ هذا الإقصاء الذي يُدعى فصلًا للسياسة عن الأخلاق كان خطوةً محوريّة في نشأة المجال السياسيّ الحديث[6]. وعلى هذا فإنّه ما من نظام إسلاميّ حقٍّ إلا وهو يتعارض مع أسس السياسة الحديثة من هذه الناحية، لأنّ الإسلام يراعي حياة الإنسان والمجتمع في كليّتها ولا يفصل بعضَها عن بعض، في حين تَفرض العلمانيّة نظرتَها التجزيئيّة على كلٍّ مجالٍ تخوضه، والسياسة في مقدّمة مجالاتها.
ولا يعني هذا أنّ النظام الإسلاميّ يُوجِب على السلطةِ مراعاة المبادئ الإسلاميّة والعمل الصادق الدؤوب على التزامها فحسب، بل يعني قبل ذلك أنّ التربية الإسلاميّة والجماعة الإسلاميّة الروحيّة هي الواجب الأوّل، وهي نواة تأسيس السلطة في النظام الإسلاميّ. وبعبارة أوضح: يتكوّن النظام الإسلاميّ من جانبين، أوّلُهما المجتمع الإسلاميّ الذي هو مادّة هذا النظام، وهو الجانب الأسبق تشكُّلًا والأَوْلى بصرف الاهتمام إليه في العالَم الإسلاميّ اليوم، والمقصود به المجتمع الذي يعيش الإسلامَ في حياته اليومية بأكملِ ما يمكنه، والثاني هو الحُكم الإسلاميّ الذي هو شكلُ النظام، أو شقُّه السياسيّ (المؤسسيّ الرسميّ) بمصطلحات اليوم، والذي لا يمكن أن يقوم إلا بعد قطعِ أشواطٍ كبيرة من بناء المجتمع الإسلاميّ. ولا يمكن الاستغناء عن أحد الشقينِ بالآخَر لما سبق من بيان طبيعة الحياة البشريّة في ثنائيّتها التي يتميّز الإسلام بفهمها فهمًا تامًّا وتنظيمِها تنظيمًا كاملًا، والسعيُ إلى إقامة حُكم إسلامي لمجتمعٍ ليس إسلاميًّا بحقٍّ نتيجتُه العنف والقهر {فذكّر إنّما أنت مذكّر * لستَ عليهم بمصيطر} (سورة الغاشية: 21-22)، أمّا الزعمُ بالاكتفاء بالمجتمع الإسلاميّ دون حُكمٍ إسلاميّ فتناقضٌ وردٌّ لأمر الله مآلُه النقص والاندثار {ومن لم يحكم بما أنزل الله فأولئك هم الكافرون} (سورة المائدة: 44).
لا وجودَ إذًا لنظام إسلاميّ قائمٍ بذاته، أي منفصل عن المجتمع الإسلاميّ، ولئن كان القانون هو أوليّة الأوائل في النظم السياسية الغربيّة (الدستور)، فإنّ العقيدة هي أُسّ الأُسُس في النظام الإسلاميّ، وشتّان بين شكلانيةِ الأوّل وعلمانيّته اللتين أوردتاه ولا تزال توردانه والبشريّةَ المهالِك، وحقيقةِ الثاني وإسلاميّتِه اللتين تجعلانه خلاصَ السياسة البشريّة.[7]
يقف في وجه النظام الإسلاميّ خصمان اثنان، أولهما المحافظون من المسلمين، وهم قوم لم يروا في الإسلام إلا بُعدَه الدينيّ المجرّد بالمعنى الأوربي للكلمة، وأغلبُهم من ذوي النزعات الصوفيّة الطرقية في عصرنا الحديث، والخصم الثاني هم دعاة الحداثة الذين نبتت نابتتهم في العالَم الإسلاميّ واشتدّت منذ وصول المستعمر الأوربيّ والبعثات العربيّة الأولى إلى غرب أوربا؛ ومشكلة الفريقين كليهما مع خاصية الإسلام الفريدة في الجمع بين العالَمَين الطبيعيّ والروحي كما أسلفنا، فالأوائل يرون أنّه لا ينبغي له ذلك بدافع التقديس الخاطئ، والآخَرون يزعمون أنّه لا يستطيع ذلك، والنتيجة العمليّة واحدة، وهي إقصاء الإسلام من المجالات العمليّة في تنظيم حياة البشر وعلى رأسها مجال السياسة.
بالرغم من كثرة الحداثيين المتزايدة في القبض على زمام السلطة في العالَم الإسلاميّ، يظلّ الخطر الأشدّ على الإسلام يأتيه من أبنائه الذين يضحّون بعقيدة الوحدانية إذا ما تعلّق الأمر بمجالات تطبيقها في الحياة، فالكهنوت الإسلامي -بعبارة عزت بيغوفيتش- يرى العقيدة الإسلامية عاجزةً عن خوض هذه المجالات فيقصيها، وهو بذلك يمهّد الطريق واسعًا لدعاة الحداثة ليستولوا عليها وينفردوا بها دون الشعوب الإسلاميّة التي ما فتئت ترجع إلى طلب الهداية في الإسلام بعد كلّ نكبة، وما أكثرها من نكبات! إنّ الفكر الإسلامي محكومٌ عليه أن يخوض جهادًا ضدّ طائفةٍ من بني الإسلام تحطّ من قدْرِه، وطائفةٍ من دعاة الحداثة تجاهر برفضه أو تُسِرّ به، لكنّها في الحالين تبيّت النية برفضه.[8]
لا شكّ في أنّ سوء تخطيط الحكومات سببٌ من أسباب التخلّف الذي يعيشه المسلمون في مجتمعاتهم، غير أنّ ذلك يجب ألا يحجب عنّا حقيقةَ أنّ الشعوب الإسلامية شعوب غير فعّالة وهي أقرب إلى الخمول والتواكل منها إلى العمل والجدّ والبذل، ولكنّ سلبيّة الجماهير هذه في -نظر عزت بيغوفيتش- سلبيةٌ نسبية لا مطلقة، ومردُّها إلى خيانة النخب الحاكمة الحداثيّة لشعوبها حين خانت الإسلام وولّت له ظهرها حين ولّت صوبَ قيم الحداثة ومشاريعها خائنةً قيم الإسلام المتجذّرة في نفوس الشعوب الإسلاميّة أكثر من أي شيء آخَر، على الأقلّ إلى زمن كتابة عزت بيغوفيتش “الإعلان الإسلاميّ”.
إنّ كلّ فكرةٍ غيرِ الإسلام محكومٌ عليها بالفشل في تحفيز المسلمين، ولا ينتج عن خيانة بعض المسلمين أو غيرهم من نخب العالَم الإسلاميّ لأفكارهم الأصيلة إلا المسخ الذي هو من نتائج انتقام الأفكار المخذولة كما يرى بن نبي. وفي الإسلام، لا تضحيةَ لشيء سوى الإسلام، ولا تضحيةَ لدولةٍ ما لم تكن دولةَ الإسلام، والجماهير المسلمة ترفض أهداف الكفاح الحداثيّ، وإنّ من مظاهر تخلّي نخب العالم الإسلاميّ عن الإسلام تخلِّيَهم عن الفكر الإسلاميّ ومحاولاتِهم قمعَه من دون يأس! ونتيجةُ ذلك الحرمان من التربية الإسلاميّة الصحيحة، ونتيجةُ هذا السطحيّةُ والاصطناع والاغتراب الذي ألقى جرانه اليوم على كل قطرٍ من أقطار العالَم الإسلاميّ. بناءً على هذا يرى عزت بيغوفيتش أنّ الحلّ الوحيد للمجتمعات الإسلاميّة هو تكوين نخبةٍ إسلاميةٍ ترفع مع الجماهير المسلمة رايةَ النظام الإسلاميّ ليعود إليهم الاهتداء والفعّالية في الوقت نفسِه.[9]
بقي أن نشيرَ إلى أنّ النظام الإسلاميّ يغرف من محيطه المكانيّ والزمانيّ ما يغرف ما دام ذلك في إطار المبادئ الإسلامية، فليس في الإسلام نظام سياسيّ مفصّلٌ جاهز، إنّما هي مبادئ يتحرّك داخلَها المجتهدون المسلمون (مبادئ ثابتة ونظم زمنية). كما يلزم أن نشيرَ إلى أنّ طبيعة الإسلام الشاملة تؤدّي بالضرورة إلى ضرورة هيمنته في كافة مجالات الحياة، وهو ما يؤدي رأسًا إلى تنافُره مع أي نُظُمٍ لا إسلاميّة، إنّ فكرة التعايش بين النظام والإسلاميّ ونظامٍ آخَر في رقعةٍ واحدة وشعبٍ واحد هي دعوى مرفوضةٌ من الأساس.[10]
ثانيا: الطبيعـــــــــة الإسلاميـــــــــــة للقانــــــــــــون
نظرًا إلى خصوصية طبيعة الإسلام فإنّ النظام القانونيّ فيه مختلفٌ في أساسه عن النظم القانونية الأخرى، ويعرّف عزت بيغوفيتش القانون بأنّه ((المصلحة الإنسانيّة تمّ إقرارُها كحقّ)) [11]. فانظر كيف جمع التعريف بين المصلحة التي لا يفهمها الدين المجرّد، والحقّ الذي لا تفهمه الماديّة؛ ذلك أنّه لا مفرَّ -على المستوى الفلسفيّ البحت- من التناقض بين المصلحة المشتركة التي يقوم عليها القانون عند الماديين، والحقّ الفطري للفرد الذي تقوم عليه الفلسفات الإنسانيّة في مقابل الماديّة، وهذا ما يعبّر عنه عموم الناس بالجمع بين حقّ الفرد ومصلحة المجتمع، وهو لا يُوجَد بصفةٍ أصيلةٍ إلا في الإسلام، أمّا في الممارسات القانونية مشرقا ومغربا فهو ليس إلا محاولات مجتزَأة للحفاظ على توازن الإنسانية فرضتها طبيعة الإنسان على فلسفات قانون هي منحازةٌ إلى أحد الطرفين أساسًا.
في الماركسية التي هي النموذج الأوضح للمادية في هذا العصر، ليس التاريخ أو الصراع الطبقي صراعًا بين حقوق متعارضة، إنّما هو صراعٌ بين مصالحَ متعارضة، فالماديّة لا تعترف بشيء اسمُه حقّ، ونظامها القانونيّ لا يهدف إلى تحقيق العدالة ومنع الظلم كما تفهمه النزعة الإنسانية، إنّما هو يمثّل مصالح المنتصرين في الصراع، وفي هذه النقطةِ يقع التناقض الصارخ مع طبيعة القانون من حيث التعريف، ذلك أنّ القانون يأتي من أجل الضعيف عبر تقييده للسلطة (يبدأ القانون حيث تنتهي السلطة)، أمّا لو جعلناه نتيجةً للصراع الطبقي وأداةً بيد المنتصر فقط فسيكون القانون والسلطة معًا بيد القويّ على الضعيف، وهذا الرأي الماركسيّ لم يقتصر على نقد القانون الذي تضعه الطبقة الرأسمالية للسيطرة والهيمنة، بل تبنّته الأحزاب الشيوعية أيضًا ضرورةً، لأنّه لازمٌ لتفسيرهم للتاريخ، ومن هنا مشكلة الرؤية الماركسيّة والماديّة عموما للقانون، إنّها تُبطِل جوهر القانون لأنّها تسيّسُه.
في الجهة المقابلة ينتفي شيءٌ اسمه “قانون” في الدين المجرّد، والمقصود هنا قانون يستنبطه البشر من مبادئ معيّنة أو نصٍّ إلهيّ ويسهرون على الالتزام به، فالدين المجرّد عدوُّه اللدود هو السلطة الماديّة، والقانون لا يمكن أن يوجد من دون سلطةٍ ماديّةٍ تدعمه، وإلّا صار مواعظَ وحبرًا على ورق.
لا قانون إذًا في ظلّ الفلسفة الماديّة أو الدين المجرّد، لا قانون إلا مع الاعتراف بالثنائيّة بهذا القدْر أو ذاك، وهذا ما يبيّنه التاريخ حين يُظهر لنا أنّ القانون يأتي دائمًا في مرحلة نضج يحصل فيها شيءٌ من التوازن بين الديني والاجتماعيّ، ولقد كان القانون الرومانيّ نتاج تزاوُجٍ بين المصلحة التي عرفها المجتمع الرومانيّ المنغمس في الحياة الماديّة، ومثاليّة القانون العامّ أو الطبيعيّ عند الرواقيين.
من نتائج هذا أنّ الطوبيات الماديّة لا تعترف بالعقاب، إنّما تمثّل الجزاءات القانونية فيها حمايةً للمجتمع، فالفرد غير مُهمّ ودوافعه إلى خرق القانون غيرُ معتبرة، وهو في نهاية المطاف مُجبَرٌ على إتيان ما أتاه لأنّه ليس إلا قَشَّةً في مهبّ ريح العوامل الموضوعية، أمّا العقاب فإنّما يكون بعد قبول مفهوم “الذنب”، وهو مفهومٌ دينيّ بامتياز، ويستلزم حريةً لا مكانَ لها في الطوبيا، إنّما محلُّها الدين، ولا عبرةَ بتحريف الألفاظ باختلاقِ مصطلحٍ مثل “النظام الأخلاقي” بدل “الدين” أو “الله”، لأنّ هذا لا يمكن أن يكون أكثر من لفظ، أمّا مضمونُه فلا يمكن إلا أن يكون دينيًّا.
إذا تبيّن هذا فإنّ البيئة الفُضلى لنشأة القانون هي المجتمع الإسلاميّ لأصالة الثنائيّة فيه، فالإسلام نظامٌ أوحدُ في تحقيق وحدة الهويّة بين القانون والدين، وإنّ تاريخ القانون في عصور الحُكم الإسلاميّ ولجوءَ الغرب في بداياته إلى القانون الإسلاميّ (الفقه) لتطوير نظم قانونية عامّة ليدُلّ على ما ذهب إليه عزت بيغوفيتش.
بين هذا وذاك يأتي الإسلام بمنظومةٍ قانونيةٍ تُقِرّ بالذنب والعقاب باعتبارهما مفهومين أصيلين، وتعترف بالمقابل بمصلحة المجتمع وحفظِها باعتبارها مصلحةً كبرى، ويتداخل الجانبان في الفقه الإسلاميّ تداخُلًا لا يُشعِر بأدنى درجةٍ من التنافُر، وذلك من أمارات كمال الإسلام.[12]
ثالثا: مبـــــــــادئ النظـــــــــام الإسلامــــــــــيّ
لم يكتفِ علي عزت بيغوفيتش ببيان فلسفة الإسلام ونظامه القانونيّ وأنّ النظام الإسلاميّ له جانبان هما المجتمع الإسلاميّ والحُكم الإسلاميّ، بل اجتهدَ في تقرير مبادئَ يرى أنّها الإطار العامّ لكلّ نظامٍ إسلاميّ في هذا العصر، وقد حاولنا تقسيمَها وعرضَها في ما يلي:
الدولـــــــة والمجتمــــــــع
إنّ الخلاص الوحيد الممكن للإنسان هو تجديد روحه، ومن هنا تبدأ الدعوة الإسلامية وإلى هنا تنتهي، لهذا كانت نواة بناء المجتمع الإسلاميّ هي الجماعة الروحيّة، فهو تعبيرٌ عن علاقات جوّانية بين إنسان وإنسان آخَر، وذلك ما يميّزه عن المجتمعات التجريدية في النظم الطوباوية التي تتمثّل علاقاتٍ برّانيةً بين عضوٍ مجهول في مجتمع وعضوٍ مجهول آخَر، وهذا لازمٌ للطوبيات بطبيعتها.
إنّ المجتمع الإسلاميّ لا يتأسس على تخطيط مُجرَّدٍ مُسبَق لعلاقاته الاجتماعية، بل هو ينشأ على قاعدة الأخوّة الإسلاميّة، وقد كان من أوّل ما فعله محمد رسول الله صلى الله عليه وسلم حين وصل المدينةَ أن آخَى بين المهاجرين والأنصار. لم تكن تلك المؤاخاة حادثةً عاطفية عابرة كما قد يُخيّل إلى بعض الناس من هذه العبارة، بل كانت ثورةً في جوهر مجتمع يثربَ آنذاك، وفي الفكر الاجتماعيّ عمومًا إلى يوم الناس هذا.
الجماعةُ من هذا النوع (أي الجماعة بالمعنى الإسلاميّ) تسودُها الألفة وينعدم فيها الاغتراب بطبعها، وإنّ من أهمّ نتائجها السياسيّة ذات الوزن الكبير في عالَم اليوم أنّها يمكن أن تنعَم برأي عامّ فعّال من دون عنف أو شغب، وذلك لطبيعة التقارب الفكريّ والنفسيّ الشديدين اللذين يميّزان جماعةً كهذه. كذلك، تحلّ هذه الجماعة مشكلةً كبرى من مشكلات السياسة الحديثة، وهي التناقض بين حفظ العدالة والتقليل من تدخّل الدولة (العدالة =/= الحريّة)؛ فالعدالة بين المسلمين في النظام الإسلاميّ حافظُها الأساس هو ما في قلوبهم من التقوى وخشية الله والحسّ الإسلاميّ لا تدخُّلُ الدولة، وبهذا تُحَقِّق الجماعةُ الإسلامية على المستوى السياسيّ ما سمّاه جون جاك روسو “الإرادة العامّة” لصاحب السيادة الذي هو الشعب ولم يستطع أن يعرضَه إلا بطريقةٍ تجعله يبدو أسطورةً ليست ممكنةً واقعيًّا[13]، أو هي تُحقّق تصوُّرَ مايكل ساندل الذي رأى أنّ العدالةَ ليست مُعطًى مُسبقًا على الجماعة، بل إنّ هذه الأخيرة في تفاعُلها هي من يُنتج مضمونًا للعدالة[14]، وهذا هو الجانب البشريّ من عدالة الجماعة الإسلامية، غير أنّها تعترف فوق ذلك بجانبٍ متعالٍ يتمثّل في الوحي الإلهيّ، والجانب البشريّ هو التربية الدينية التي تجعل الجانب الإلهيّ هو تصوُّرَ الجماعة المُشترَك للعدالة، وعليه فإنّ الفشل في جانب الدعوة التربوية ينتُج عنه بالضرورة عجزٌ عن تحقيق العدالة الإسلاميّة. وبهذا التصوُّر تصير الديمقراطية بمعناها الإنسانيّ الواسع غير العلمانيّ ركيزةً من ركائز النظام الإسلاميّ.[15]
التربية هي إذًا لُبّ وجود المجتمع الإسلاميّ، وبعد أن يصل الأمر إلى إقامة الحُكم الإسلاميّ فإنّه يصير واجبًا على من يتولّون الحُكم (أي تسيير شؤون الناس العامّة) أن يحرصوا على التمكين لاستمرار التربية الصحيحة والقضاء على أشكال التربية الخاطئة، ومن هنا تصير حريّة الإنسان في مجتمعٍ قائمٍ على العدالة الإسلاميّة متمثِّلةً في حفظ شروط العدالة هذه، وذلك بإحلال الحلال وتحريم الحرام، فالحُكم الإسلاميّ لا يقبل الوقوف مكتوفَ الأيدي في وجه المحرّمات، لأنّه مسؤول عن الحفاظ على شروط العدالة الإسلامية التي تقوم على التزام أمر الله والعبوديّة له، وبهذا يكون الحُكم الإسلاميّ حكمًا إسلاميًّا فقط، لا هو دينيّ بالمعنى الأوربي للكلمة، لأنّ الدين بهذا المعنى يتناقض مع فكرة الحُكم من أصلِها، ولا هو علمانيّ (أو مدنيّ في استعمال بعض الناس لمعنى علمانيّ نفسِه) لأنّ العدالةَ في الإسلام لا يمكن أن تنفصل عن شرع الله إطلاقًا.[16]
المواطنــــة في النظــــام الإسلامـــــي
لا يعترف الإسلام بفضلٍ لأحدٍ من الناس على أحد بغير التقوى، أي المعيار الأخلاقي، فالأصل في الناس أنهم كلَّهم سواسيةٌ أمام الله وأمام شريعة الإسلام، وهذه ثاني ركيزةٍ للتصوُّر الإسلامي بعد الاعتقاد بوحدانيّة الله، فقد جاء في خُطبة حَجّة الوداع التي كانت بمثابة الوصيّة الكبرى الأخيرة لرسول الله صلى الله عليه وسلّم: ((يا أيّها الناس! ألا إنّ ربكم واحد، وإنّ أباكُم واحد، ألا لا فضلَ لعربيّ على أعجميّ ولا لعَجَميّ على عربيّ ولا لأحمرَ على أسودَ ولا أسودَ على أحمرَ إلا بالتقوى)).[17]
إنّ الناس كلَّهم عبادٌ لله، وعليه فهُمْ كلهم سواسيةٌ أمام شرع الله، لا يعلو أحدٌ على أحد في ضرورة الامتثال لأحكامه وتشريعاته. وبما أنّ كلّ مجالات الحياة محكومةٌ بشرع الله في الإسلام بما كمّله الله وأتمّ به نعمته على البشر، فإنّ المساواة القانونية والسياسية مكفولتان بقوّة العقيدة، ولا يمكن أن يُخرمَ منهما إلا بقدرِ ما ينقص من عقيدة المسلمين.[18]
وبالنظر إلى عموم الرسالة الإسلاميّة للبشرية جمعاء وإلى طبيعة حاكميّتها التي لا يقبل الإسلام حَكَمًا فوقها لأنّها حُكمُ الله، فإنّ مفهوم المواطنةِ المُرتبِط بالدولة الحديثة يجدُ نفسَه موضع نقدٍ من الفكر الإسلاميّ، وإن قبِلَه مؤقتًا لدواعٍ عمليّة فإنّه لا يمكن أن يكون عقيدةً سياسية للمُسلِم، ويُمكن الرجوع في هذه النقطة إلى نقد المفكّر الإسلاميّ طه عبد الرحمن لهذا المفهوم في نقدِه للحداثة الغربية واقتراحه بدائل له مثل “المؤاخاة” من ناحية الفلسفة الاجتماعية [19] “والمخالَقة” من ناحية الفلسفة التربوية [20].
يرى عزت بيغوفيتش أنّ “الأخوّة” بين المسلمين هي المفهوم الحقّ الذي تقوم عليه الجماعة الإسلامية لا المواطنة، وعلى النظام الإسلاميّ أن يطوّر مؤسساتٍ وإجراءاتٍ لتحقيق الأخوّة الإسلاميّة وتوطيد أركانها وجعلِها روحَ تماسُك الجماعة السياسية الإسلامية وعمودَ الدولة التي لن تكون صورةً طبق الأصل للدولة الحديثة من دون شكّ. بناءً على هذا، ليس الإسلام مجرّد جنسيّة، ولا هو قومية من القوميّات كما يصنّفه كثيرٌ من الباحثين صراحةً أو ضمنًا، إنّما هو على الدوام واقعٌ متجسّدٌ وحقيقةٌ متجاوِزة ومشروعٌ أيديولوجيّ مطلوبٌ تحقيقُه في الوقت نفسِه، عمودُه الداخليّ الجماعة الإسلاميّة، وامتدادُه الخارجيّ الجامعةُ الإسلاميّة.
ويشير صاحب “الإعلان الإسلاميّ” إلى تناقض روح الإسلام مع روح النظام الإقطاعيّ، كأنّه بذلك يردّ على كثيرٍ من المؤرّخين والمنظّرين الذين يصنّفون الحُكم الإسلاميّ على أنّه حُكمٌ إقطاعيّ لتتمّ له وحدة الصورة الخطّيّة التي قدّمها الغرب للتاريخ الاقتصادي مثل ما هي الحال عند الماركسيين، أو للتاريخ السياسيّ.[21]
ينتُج عن طبيعة العلاقة بين المجتمع الإسلامي والحُكم الإسلاميّ أنّ الأكثريةَ المُسلمةَ المؤمنة بِحُكم الشريعة العاملةَ من أجلها شرطٌ لا غِنًى عنه من أجل إقامة النظام الإسلاميّ، وفي هذا حلٌّ نهائي لمشكلة الديمقراطية في الإسلام، بالمعنى العامّ للديمقراطية لا بمعناها العلمانيّ الحديث.
((وللأقليات غير المسلمة في الدول الإسلامية حق التمتع بالحرية الدينية والحماية الكاملة بشرط ولائها للدولة.
أما الأقليات المسلمة في المجتمعات غير الإسلامية ما دامت حريّتُها في ممارسة العقيدة مضمونة وما دامت قادرة على ممارسة حياة طبيعية، فإنّ عليها الوفاءَ بواجباتها إزاء هذه المجتمعات إلا ما يكون منها ضارًّا بالإسلام والمسلمين.
والحقّ أنّ وضْعَ الأقليات المسلمة في البلاد غير الإسلامية يتوقف دائما على قوّة المجتمع الإسلامي وهيبتِه “في العالَم”)).[22]
الاقتصــــــــــاد في النظـــــــام الإسلامــــــــــــي
من ناحية الاقتصاد، لا ينفي الإسلام المِلكية الفردية كما تفعل الشيوعية، غير أنّه لا يُطلِق لها العِنان كما تفعل الرأسمالية، فالملكية الشخصية فيه مقيّدةٌ بقيودِ التشريعات الإسلامية والتوجيهات العقَديّة، والثروةُ في حقيقتِها اجتماعية، والمالُ مالُ الله، وما الإنسانُ إلا خليفةٌ فيه {وأنفقوا مما جعلكم مستخلَفين فيه} (سورة الحديد: 7).
تمثّل الزكاة التشريع الأساس الذي يقيّد المِلكية الفردية، وهي مؤسسة دينية اجتماعية مفصلةٌ تفصيلًا في الفقه الإسلاميّ، غير أنّ الأمر لا يقتصر على ذلك، بل نبعت من روح الزكاة والنظرةِ إلى الثروة في الإسلام مؤسساتٌ اجتماعية أخرى مثّلت نماذجَ إنسانيةً خالدة في توزيع الثروة والتكافل الاجتماعيّ وتنظيم العلاقات الاقتصادية، وعلى رأسها مؤسسة الوقف.
العمود الاقتصاديّ الثاني في الإسلام هو التحريم المُغلَّظ للربا واعتبارُها من أكبر الكبائر وترتيبُ عقوبةٍ شديدة على التعامُل بها بأيّ صفةٍ من الصفات، وجعلُ ذلك إيذانًا بالحرب من الله ورسوله {يا أيّها الذين ءامنوا اتقوا الله وذرُوا ما بقيَ من الربا إن كنتم مُومِنين * فإن لم تفعلوا فاذَنوا بحربٍ من الله ورسوله وإن تُبتُم فلكُم رُءوس أموالكم لا تَظلِمون ولا تُظلَمون} (سورة البقرة: 278-279) ، وذلك حفظًا لقيمة العمل، وإيصادًا للباب في وجه الاحتكار بكلّ طرقه.[23]
هذا من ناحية العدالة الاقتصادية، أمّا من ناحية التنمية الاقتصادية فيعلّق عزت بيغوفيتش الآمال على التعليم، ويعتبرُه أعظم مجالات الاستثمار عائدًا، ((فإذا لم نفشل في برامجنا التعليمية فلن نفشلَ في أيّ مجالٍ آخَر))، فإن انضافت إليه الوحدة بين المجتمعات الإسلامية كان ذلك الطريق الصحيح لتسريع تحرير العالَم المُسلِم.[24]
فلسفـــــــــــــــة الحُكـــــــــــم الإسلامـــــــــــــي
في ما يخصّ نظام الحُكم في الإسلام، يرى علي عزت بيغوفيتش أنّ مبدأَه جمهوريّ، ومرجِعُ ذلك أن لا إرثَ في الإسلام إلا في المِلكيّة، ويعضُده فكرة البيعة وعملُ الخلفاء الراشدين بعد رسول الله صلى الله عليه وسلّم.
تتضمّن كلمةُ “لا إله إلا الله” أن لا حُكمَ لأحدٍ من البشر على أحد في حقيقة الأمر، وأنّ الأمر كلّه لله لأنّ العبادة كلَّها له لا يصحّ منها شيء لغيره سبحانه، وينتج عن هذا أمران اثنان متعلقان بنظام الحُكم في الإسلام، أولهما الديمقراطية المُطلَقة للفرد، والثاني السلطة المُطلقة للبرامج نظرًا إلى أنّها تعبيرٌ عمّا يريدُه الله ما دامت تدورُ في فَلَك الشريعة.
وفي الإسلام لا عصمةَ للحُكّام والمنظّرين، ولا خُلُودَ للنُظُم والأفكار، لا مُطلَقَ إلا اللهُ ولا كمال إلا لشرعِه، وكلّ البطولات الأسطورية التي تملأ صفحات التاريخ قديمًا وحديثًا ليست أكثر من وثنيةٍ زائغة.[25]
الحريـــــــــــــات في النظـــــــــــــــام الإسلامــــــــــــــــي
لا حريةَ للمُسلِم بغير الإسلام، بل لا حريّةَ حقيقيةَ للإنسان عمومًا من دونه، وقد لخّص هذا المعنى الصحابي الجليل ربعيّ بن عامر رضي الله عنه في مقولته المعروفة لرُستُم قائد الفُرس التي جاء فيها ((اللهُ ابتعثنا لنُخرَج من شاءَ مِن عبادة العباد إلى عبادة الله)).[26]
وكلّ استقلالٍ من دون القدرةِ على إقامة نظامٍ إسلاميّ فهو استقلال زائف بالنسبة إلى المسلمين، وأوّل طريقِ الاستقلال الحقيقيّ للمسلمين الاستقلال الروحيّ من كلّ عبوديةٍ لغير الله والتزامٍ بغير أمر الله وعيشٍ بغير شريعة الله. هذه الحقيقة تجعل النظام الإسلاميّ أرفع درجاتِ الديمقراطية للمجتمعات الإسلامية، وتفسّر أنّ دعمَ الشعب المُسلِم لأيّ نظامٍ في السلطة يتناسبُ طرديًّا مع مقدار إسلاميّته.[27]
يقرّر الله بكلّ وضوحٍ أن {لا إكراهَ في الدين} (البقرة: 256)، سواءٌ في ذلك الجانبان الماديُّ والنفسيّ للإكراه، ويكفل النظام الإسلامي على أساسِ ذلك حريَّةَ الضمير لكلّ من يعيش تحت كنفه. غير أنّ هذا لا يمنع تدخُّل الحُكومة الإسلامية في وسائل الإعلام المختلفة من أجل حفظِها من الانحراف ومن التفاهة كليهما، فذلك ممّا يقتضيه قيامُها بحفظ العدالة الإسلاميّة -كما سبق-.[28]
وجوابًا على دعاوى النسوية، يرى علي عزت بيغوفيتش أنّ المرأة تتميّز بالقيمةِ ذاتِها التي للرجل، لا فرقَ بينهما من هذه الناحية، وذلك ليس مجرّد دعوى من بعض الإسلاميين بل هي حقيقة إسلامية لا جدالَ فيها بدليل أنّ الله سوّى بينهما في الالتزامات الدينية والأخلاقية كما هو واضحٌ في شريعة الإسلام.
أمّا دعاوى حرية المرأة في الغرب فتقع في أحد انحرافَين، تحويلِها أداةً لاستمتاع الرجل، أو اتخاذِها إلهًا يُعبَد من دون الله يتخذ لنفسِه ما يشاء من الحقوق والميزات ولا يملك الرجل تجاهها إلا الإذعان والخضوع. تعبّر عن انحراف الاستمتاع (الأداتيّة) مظاهرُ كثيرةٌ من مظاهر الحضارة الغربية المعاصرة، مثل استعمال المرأة في الإعلانات وأزياء الموضة النسوية ومحاربة مؤسسة الأسرة وتعبيد السُبُل إلى الفحشاء، في حين يعبّر عن انحرافِ العبادة شراسةُ التيارات النسوية على الصُّعُد كافّة والاستجابات التشريعية لها ومحاولات إحداث منعطفات خطيرة في تاريخ البشرية (ومن الأمثلة المعبّرة عن عمق المشكلة ما عُرف في بعض بلاد الغرب من اختراعٍ لضمائرَ جديدةٍ في اللغة يُطالَبُ باستبدالها بضميري المذكّر والمؤنّث الطبيعيَّين في لغات البشر المختلِفة منذ أقدم الأزمان!).
يدعو عزت بيغوفيتش إلى الاجتهاد من جديدٍ في قانون الأسرة في العالَم الإسلاميّ، غير أنّ الاجتهاد يجب ألّا يخرج عن دائرة مبادئ الإسلام والفطرة في هذا المجال، بل يتحرّك في مساحات التغيُّر الطبيعية الفرعيّة. وينظر عزت بيغوفيتش إلى المرأة في النظام الإسلاميّ باعتبارِها أمًا ومعلّمة، هاتان الوظيفتان هما عمودَا مفهوم المرأة في الإسلام، وعليهما يجب أن تتأسس نظرة النظام الإسلامي إلى المرأة وما ينتج عنها من مؤسسات وتشريعات يجب أن يُحذَر فيها من الوقوع في كارثة تجريد الحياة من الأمومة كما هو واقعٌ في بلاد الغرب، معظمِها أو كلِّها، وكما بدأ ينتقل إلى العالَم الإسلاميّ منذ عقود قليلة، بوتيرة متزايدة، ((وبدلًا من فكرة المساواة المُطلَقة يضمن الإسلام للمرأة المحبّة والحياة الزوجية والأطفال وكلّ ما تعنيه هذه الأمور الثلاثة للمرأة)).[29]
الآخَر غيــــــر المُسلـــــــــــم في النظـــــــــام الإسلامـــــــــــــي
ذروة سنام الإسلامِ الجهادُ في سبيل الله، وقد ورد الأمر به وإعلاء شأنِه بغزارة في القرآن الكريم، ومعناه وتفصيلاتُه مبثوثةٌ في كتب الشريعة الإسلاميّة، ومعلومٌ منها أنّ الجريمةَ لا مكانَ لها فيه[30].
يُشرَع الجهادُ لدفاع المسلمين عن أنفُسهم، ولنشر رسالة الإسلام بين الناس في وجهِ من يمنعون الدعاةَ إلى الله من إيصال دينِه سبحانه إلى عبادِه، فالأرضُ أرضُ الله {إنّ الأرض لله} (سورة الأعراف: 128)، والخلقُ خلقُ الله {الحمد لله رب العالَمين} (سورة الفاتحة: 2)، والرسالةُ الإسلاميّة عامّة {وما أرسلناك إلا كافةً للناس بشيرًا ونذيرا} (سورة سبأ: 28)، ولا نجاةَ في الآخرة لمن بلغَتْهم من الإنس والجنّ إلا بها {ومن يبتغِ غير الإسلام دينا فلن يُقبَل منه وهو في الآخرة من الخاسرين} (سورة آل عمران: 85)، ولا طمأنينةَ للبشرية في هذه الحياة إلا بها {وأنّ هذا صراطي مستقيمًا فاتّبعوه ولا تتبعوا السُّبُل فتَفَرَّقَ بكم عن سبيلِه} (سورة الأنعام: 153). فإن سوّلت لأحدٍ نفسُه أو لقومٍ أنفُسُهم أن يصدّوا عباد الله عن معرفة رسالة الله إلى عبادِه وأن يؤمن مِنهم من قبِلَها بقلبِه ويلتزم بها بجوارحه ويدعُوَ إليها بلسانه وأفعالِه، كان حقًّا على المسلمين أن يُجاهدوا من يصدّ عن سبيل الله من آمن، ويُشتَرَط في ذلك القدرة على جهادِه، ويجب عليهم أن يسْعوا بكلّ السبل المشروعة في الإسلام من أجل أن يحقّقوا تلك القدرة {وأعِدُّوا لهم ما استطعتُم من قوةٍ ومن رباط الخيل تُرهِبون به عدُوَّ الله وعدُوَّكم وآخرين مِن دونهم لا تعلمونهم اللهُ يعلمهم وما تُنفقوا من شيء في سبيل الله يُوَفَّ إليكم وأنتم لا تُظلَمون} (سورة الأنفال: 60).
أمّا غيرُ المسلمين الذين لا يُقاتلون المسلمين ولا يمنعون بالقوّة الماديّةِ رسالةَ الله أن تصل إلى خلقِه فلا جهادَ فيهم إلا من نقض عهدًا أو بدرَ منه تهديد {وإن نكثوا أيمانَهم مِن بعد عهدِهم وطعنوا في دينكم فقاتلوا أئمّة الكُفر إنّهم لا أَيْمانَ لهم لعلّهم ينتهون} (سورة التوبة: 12) {وإمّا تخافَنّ من قومٍ خيانةً فانبِذ إليهم على سواء إنّ الله لا يحبّ الخائنين} (سورة الأنفال: 58)، وتظلّ السّلم مرغوبًا فيها ما بدرَت بادرةٌ تجعلُها ممكنة {وإن جَنَحُوا للسَّلْمِ فاجنح لها وتوكَّل على الله إنّه هو السميع العليم} (سورة الأنفال: 61).
هذا كُلُّه في تسيير حالِ الاضطراب والعداوةِ مع المجتمع الإسلاميّ، أمّا في حال عدم نصب العداوة للإسلام وأهلِه وعدم الكيدِ لدعوتِه فالعلاقةُ مع المجتمعات غير الإسلاميّة إنّما تقومُ على المُعايشة والتعارُف والبرّ والقسط {لا ينهاكم الله عن الذين لم يُقاتلوكم في الدين ولم يُخرِجوكم من دياركم أن تَبَرُّوهم وتُقسِطوا إليهم إنّ الله يُحبّ المُقسطين * إنّما ينهاكم الله عن الذين قاتلوكم في الدين وأخرجوكم مِن ديارِكم وظاهروا على إخراجكم أن تَوَلَّوْهُم ومن يتولَّهم فأولئك همُ الظالمون} (سورة الممتحنة: 8-9) {يا أيُّها الناس إنّا خلقناكم من ذكرٍ وأُنثى وجعلناكم شُعوبًا وقبائلَ لِتعارَفوا إنّ أكرمكم عند الله أتقاكُم إنّ الله عليمٌ خبير} (سورة الحُجُرات: 13).
العدلُ مع الأعداء واجبٌ إذًا في الإسلام، والانتقامُ على أثر الانتصار كما تفعلُ الدول في العصر الحديث ليس مقبولاً في الإسلام بحالٍ من الأحوال، وقد بيّنت غزواتُ محمدٍ رسول الله صلى الله عليه وسلم وتعليماتُه فيها ضرورةَ حُسن معاملة الأسرى وعدم قتالِ غير المقاتِلين والإعلام بالمعركة قبل مباشرتِها بزمنٍ كافٍ وتفضيل السلم في حال إمكانها {يا أيها النبي قُل لمن في أيديكُم مِن الأسرى إن يعلمِ الله في قلوبكم خيرًا يُؤتِكُم خيرًا مِمَّا أُخِذَ مِنكم ويغفر لكم والله غفور رحيم} (سورة الأنفال: 70).
ويلخّص عزت بيغوفيتش كيفيّة التعامُل مع المجتمعات غير المُسلِمة في المبادئ الستّ التالية:

الحرية الدينية.
-
القوّة والتصميم على الدفاع الحاسم الفعّال.
-
حظر الحروب العدوانية وجرائم الحرب.
-
التعاون المُشترَك والتعارف بين الشعوب.
-
احترام العهود والاتفاقات المعقودة.
-
المُعامَلة بالمِثْل.[31]
الخـــــاتمـــــــة
لم يخُض علي عزت بيغوفيتش -رحمه الله- مجالَ الفكر السياسيّ خوضَ المُجادِل العليمِ بمقولات السياسة في عصره الذي يرومُ أن يُدليَ فيها بدلو، ولا بنى رؤيتَه فيها على ما أعطاه إيّاه واقعه وحاضره فحسب، بل كان فكرُه السياسيّ أصيلاً من أصالةِ عُمق فهمِه لرسالة الإسلام الربّانية في عالَم البشر الذي رآه يخبطُ على غير هُدى خبطَ عشواء منذ نسيَ الله فأنساه نفسَه.
السياسةُ في الإسلام عند عزت بيغوفيتش امتدادٌ للإسلام نفسِه وتمظهرٌ من تمظهُراتِه في الحياة البشرية في عالمٍ بناه الله على التدافُع بين أهلِه، والسياسةُ الإسلاميّة اجتهادٌ مشدودٌ إلى نصّ الوحي مِمّن له الخلقُ والأمر، العليمِ الحكيم.
لا إنسانَ بِغير الإسلام.. لا سلطةَ سياسيّةً إسلاميَّةً قبل دعوة دينية وتربية إسلامية.. للإسلام مبادئُ في كلّ مجالٍ من مجالات الحياة.. الحلّ في المبدأ الصحيح والعمل الجادّ لا في شكل النظام وتقليد الآخرين.. هذه بعض تعاليمِ مُجاهد البوسنة الإنسانِ إلى المُسلمين والناس كافّة مِن بعدِه، وتلك صيحةُ إنذارِه في عصرٍ أشرفَ على الهاوية وما أخْلَقَه -لولا عنايةُ الله- بأن يتردّى فيها!
{إنّ في ذلك لذِكرى لِمَن كان له قلبٌ اَوَ الْقَى السمع وهو شهيد} (سورة ق: 37).
